Acceptable Use Policy

MachGen AI, Inc. (“MachGen,” “we,” or “our”) operates a generative media platform that provides access to artificial intelligence models, application programming interfaces, hosted inference services, and related tools (collectively, the “Services”). Our mission is to amplify human creativity while maintaining a safe, lawful, and civil community for our users and the public.

This Acceptable Use Policy (the “Policy”) governs your access to and use of the Services. By accessing or using the Services, you agree to comply with this Policy. Capitalized terms used but not defined herein have the meanings given in the MachGen Terms of Service. This Policy supplements the Terms of Service, and in the event of any conflict between this Policy and the Terms of Service, the Terms of Service control unless this Policy is expressly more restrictive.

You are solely responsible for your use of the Services and for the use of the Services by any End User to whom you provide access. Violation of this Policy may result in suspension or termination of your account and the enforcement measures described in Section 10.

1. Safety

You may not use the Services to create, generate, distribute, promote, or facilitate content or activities that endanger people, exploit minors, or further illegal acts, including the following:

  • Child sexual exploitation.Child sexual abuse material (“CSAM”), content that sexualizes or exploits minors, grooming communications, sextortion content, or the solicitation, creation, acquisition, or dissemination of any of the foregoing.
  • Non-consensual intimate imagery.Synthetic or modified depictions of a real person in a sexual or intimate context without that person’s express, informed, and contemporaneous consent.
  • Human trafficking and sexual violence. Content that facilitates, depicts, or promotes human trafficking, sexual violence, or the exploitation of vulnerable persons.
  • Self-harm. Content that promotes, glorifies, instructs, or facilitates self-harm, suicide, or eating disorders.
  • Terrorism and extremism. Content that recruits for, incites, glorifies, or provides operational support to terrorist organizations, violent extremist groups, or organized violence.
  • Weapons of mass destruction. Content that materially assists the development, acquisition, or deployment of chemical, biological, radiological, nuclear, or other weapons capable of mass casualties.

2. Civility

You may not use the Services to harm, harass, degrade, or incite violence against any person or group, including by generating or distributing:

  • Harassment. Threats, harassment, bullying, stalking, or doxxing directed at any individual or group.
  • Hate speech. Content that dehumanizes, demeans, or advocates discrimination against any individual or group on the basis of race, ethnicity, national origin, religion, caste, sex, gender identity or expression, sexual orientation, age, disability, or any other characteristic protected under applicable law.
  • Gratuitous violence. Content depicting torture, mutilation, animal abuse, or gore presented primarily to shock or offend.
  • Incitement. Content that incites violence against any person, group, institution, or property.
  • Public-interest misinformation. Content that is intentionally deceptive and likely to materially affect public health, public safety, election integrity, or civic participation.

3. Integrity

Given that the Services include generative video and synthetic media capabilities, you must use the Services honestly and transparently. You may not use the Services to:

  • Fraud and scams. Engage in fraud, scams, phishing, or any scheme intended to obtain money, credentials, or personal information through deception.
  • Identity theft. Create, alter, or use synthetic identity documents, credentials, or attributes for the purpose of impersonating another person or evading identity verification.
  • Unauthorized impersonation. Impersonate a real person, brand, or governmental entity in a manner reasonably likely to mislead a reasonable viewer.
  • Deceptive synthetic media.Generate or distribute synthetic media depicting a real person’s likeness, voice, or attributes without that person’s consent, where such use is commercial, sexual, defamatory, illegal, or otherwise harmful, or where it is reasonably likely to cause harm to the person depicted. You must comply with applicable laws governing synthetic media disclosure, including the EU AI Act, U.S. state laws (such as California AB 2655 and Tennessee’s ELVIS Act), and any other applicable transparency obligations.
  • Election interference. Create or distribute content designed to deceive voters about a candidate, ballot measure, or election process.
  • Spam. Engage in unsolicited bulk messaging, content manipulation, or coordinated inauthentic behavior across platforms.

4. Dignity

You must respect the legal rights and dignity of others. You may not use the Services to:

  • Privacy.Violate the privacy of any person, including by collecting, exposing, or generating content about them without a lawful basis under applicable privacy and data protection laws, including the General Data Protection Regulation (“GDPR”), the UK GDPR, the California Consumer Privacy Act (as amended) (“CCPA”), and other applicable laws.
  • Intellectual property. Infringe any copyright, trademark, trade secret, patent, right of publicity, or other intellectual property right.
  • Discrimination. Discriminate against any individual or group on the basis of a protected characteristic in a manner prohibited by applicable law.

5. Compliance

You must comply with all laws and regulations applicable to your use of the Services, including our Terms of Service, Privacy Policy, and any acceptable use, safety, or compliance terms imposed by the third-party model providers whose models are made available through the Services. You are solely responsible for ensuring that your use of the Services is lawful in every jurisdiction in which you operate or in which your End Users are located.

6. Criminality

You may not use the Services to plan, facilitate, commit, or generate content that supports any criminal act, or to develop, market, or transact in illegal goods or services, including weapons, controlled substances, counterfeit currency, stolen data, malware, or services for sale on dark-web marketplaces.

7. Security

You may not use the Services in any way that compromises the security or integrity of our systems, our users, or any third party, including by:

  • Sensitive personal data. Collecting, generating, or processing government-issued identifiers, financial account credentials, payment card data, protected health information, biometric identifiers, or other sensitive personal data without a lawful basis and the verifiable consent of the data subject where required by applicable law.
  • Unauthorized access. Attempting to gain unauthorized access to any account, system, model, network, or data.
  • Malicious code. Creating, distributing, or executing malware, ransomware, spyware, or other malicious code.
  • Reverse engineering. Reverse engineering, decompiling, disassembling, extracting model weights, distilling outputs to train a competing model, or otherwise deriving the underlying algorithms, parameters, or architecture of any AI model accessible through the Services, except to the extent expressly permitted by applicable law and not waivable by contract.
  • Safety circumvention. Circumventing or attempting to circumvent any content filter, safety guardrail, rate limit, watermarking system, or other protective measure implemented by MachGen or any third-party model provider.
  • Scraping. Scraping, mining, harvesting, or extracting metadata from the Services to infer personal information about other users, train competing systems, or build derivative datasets.

8. Other Restrictions

You may not access or use the Services if you:

  • are under the age of 18 (or such higher minimum age as may apply in your jurisdiction);
  • are located in, ordinarily resident in, or accessing the Services from a country, territory, or region that is the target of comprehensive sanctions or embargoes administered by (i) the U.S. Department of the Treasury’s Office of Foreign Assets Control, the U.S. Department of State, or any other U.S. government authority; (ii) the European Union or any EU Member State; (iii) His Majesty’s Treasury or any other authority of the United Kingdom; or (iv) any other governmental authority with jurisdiction over MachGen or its Affiliates; or
  • have previously had your account suspended, terminated, or banned by MachGen.

9. Managing End User Accounts

If you use the Services to build products, applications, or platforms that are made available to your own customers, developers, or end users (“End Users”), you are responsible for the conduct of your End Users on the Services. You must:

  • require your End Users to accept terms of use that are at least as protective of MachGen and its model providers as our Terms of Service and this Policy;
  • take reasonable steps to prevent and detect End User conduct that would violate this Policy, including by implementing appropriate technical filters, content moderation, abuse-reporting channels, and, where appropriate, age verification;
  • promptly report any apparent CSAM detected on your platform to the National Center for Missing & Exploited Children (or, where applicable, the corresponding authority in your jurisdiction) and to MachGen at the contact address below, and preserve associated content and metadata to the extent required by applicable law;
  • cooperate reasonably with MachGen and law enforcement in any investigation or enforcement action arising from End User conduct on the Services; and
  • ensure that your processing of personal data of End Users complies with applicable privacy laws, including providing all required notices and obtaining all required consents.

10. Enforcement

We may investigate suspected violations of this Policy at any time and take any action we deem appropriate, in our sole discretion, with or without notice to You or any End User and without any liability to You or any third party, including:

  • removing or declining to generate offending content;
  • suspending, restricting, or terminating your account or any End User account;
  • blocking IP addresses, domains, model endpoints, or other identifiers associated with violations;
  • reporting violations to law enforcement, regulatory authorities, or third-party rights holders when required by law or when we reasonably believe doing so is necessary to prevent harm; and
  • pursuing any other remedy available to us at law or in equity.

MachGen may update this Policy at any time in its sole discretion. Updates are effective immediately upon posting on this page with a revised Effective Date, and MachGen is not required to provide any other notice. Your continued use of the Services after the revised Effective Date constitutes acceptance of the updated Policy.
